Terms & Conditions: Which BMD Cowboy Are You?
Introduction
1. The Promoter is Cowboys Rugby League Football Limited, the Hutchinson Builders Centre, 26 Graham Murray Place, Railway Estate QLD 4810. ABN: 28 060 382 961
2. These terms and conditions apply to the ‘Which BMD Cowboy Are You?’ Competition, including the process we will use to select the winner(s). In these terms and conditions, we will refer to the North Queensland Toyota Cowboys as ‘the Cowboys’, ‘us’, ‘we and ‘our’. We will refer to a promotion participant as a ‘competitor’, ‘participant’, ‘you’ and ‘your’. We will refer to the ‘Which BMD Cowboy Are You?’ Competition as ‘the promotion’ and ‘the competition’. By participating in this promotion, you acknowledge and agree that you have read and understood these terms and conditions. Nothing in these terms and conditions amends, limits or excludes any rights or remedies that you may have under the Australian Consumer Law which cannot lawfully be amended, limited or excluded.[3.1]
North Queensland Cowboys Collection Statement
3. In this Collection Statement "we", "us", "our" and "Cowboys" means North Queensland Cowboys, its associates, related entities and subsidiaries. Please read this Collection Statement and our related Privacy Policy located at https://www.cowboys.com.au/privacy-policy carefully as it describes how we will collect, hold, use and disclose your Personal Information. Capitalised terms in this Collection Statement have the meaning given to such terms in the Privacy Act 1988 (Cth).
4. Capitalised terms in this Privacy Policy have the meaning given to such terms in the National Rugby League's (NRL) Privacy Policy located at https://www.nrl.com/privacy-policy.
5. Please be aware that you are under no obligation to provide us with your Personal Information, and you may request we delete any Personal Information we hold about you at any time.

Purpose of collection
7. Cowboys collects, uses, discloses or holds Personal Information that is reasonably necessary for Cowboys to perform one or more of its functions or activities set out below:
a. organisation, conduct and promotion of matches involving North Queensland Cowboys (for instance, providing you information about upcoming ticket offers and deals for the next home matches);
b. promotion and sale of North Queensland Cowboys merchandise;
c. direct marketing of North Queensland Cowboys products or services;
d. complying with the NRL Rules; and
e. conducting our other functions including entertainment, community engagement and support, sponsorship, hospitality, training and education.
Consequences of your refusal to provide personal information [JK9.1][10.1]
8. The mandatory contact details collected from participants are required to administer the promotion, verify eligibility and contact the winner. Any consent to receive marketing communications is optional and is not a condition of entry. Declining to provide marketing consent will not affect a participant's eligibility for the promotion or their chances of winning.
9. The main consequence if you do not provide Cowboys with your Personal Information is that we will not be able to provide you with information about our upcoming matches and the products and services we provide, including things such as discount offers, ticketing and exciting initiatives we are undertaking.
Disclosure to third parties
10. Cowboys may disclose your Personal Information to (without limitation)
a. delivery, courier and postal organizations: we may disclose your Personal Information to delivery, courier and postal organizations in order to deliver merchandise you order;
b. the NRL, Queensland Rugby League, New South Wales Rugby League, Country Rugby League of NSW and selected third parties (for instance, Ticketek and Ticketmaster): we may disclose your Personal Information as part of the Rugby League Exchange (to see more information about the Rugby League Exchange, please visit the NRL Privacy Policy). The NRL and selected third parties may send you information about products and services that may be of interest to you. If you do not wish to receive information from the NRL, please opt out from such promotional and marketing information via your NRL account, links in emails and other communication we send to you from time to time or contact the NRL's Privacy Officer in accordance with the NRL Privacy Policy. If you do not wish to receive information from other selected third parties, please opt out from such promotional and marketing information as part of the relevant organisation's preference centre;
c. law enforcement and emergency services agencies: we may disclose your Personal Information where required or authorized to do so by law, including in emergency situations and to assist law enforcement
11. agencies with active investigations. We will always ensure that those to whom we disclose your Personal Information have the legal right to receive it; and
a. marketing and promotions: we engage email marketing providers, market research companies, promotions management and other data analytics companies to perform direct marketing on our behalf. You will always have the right to opt out of receiving promotional materials from us.
12. The type of Personal Information we may disclose to those third parties includes (without limitation) your name, date of birth, address, phone number, email address, favourite players and any other Personal Information collected that is relevant to the purpose of the disclosure. Other than overseas recipients (see clause 5), we ensure that any organisation to which we disclose your Personal Information implements appropriate information security safeguards and protections in accordance with applicable privacy laws (including the Privacy Act and GDPR). In certain circumstances, we may disclose your Personal Information if and when required to do so by law, for example, to assist law enforcement agencies with their inquiries.[14.1]

13. We may disclose your Personal Information to overseas recipients for things such as processing membership and hosting services. The most likely destinations for such activities are China, Singapore, the United States and New Zealand, although countries where such recipients are located may vary. By accepting this Collection Statement and providing the Cowboys with your Personal Information, you are providing express consent for the Cowboys to disclose your Personal Information overseas. You are aware that by providing such consent, the Cowboys will cease to be accountable for the overseas recipient's handling of your Personal Information under applicable privacy laws (including the Privacy Act and GDPR) and that you will not be able to seek redress from the Cowboys under applicable privacy laws (including the Privacy Act and GDPR) in relation to that use of your Personal Information overseas.

Promotion details:
18. Information on how to enter and the prize form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
19. Competition opens 3pm Friday 28 August and closes 11.59pm Friday 18 September 2026.
Entry method:
20. To enter the promotion, individuals must complete the following steps during the Promotional period:
a. Go to https://comps.cowboys.com.au/tb_app/557573137 and take the ‘Which BMD Cowboy are you?’ personality quiz.
b. Complete all the required data entry fields on the entry form.
c. A maximum of one (1) entry is permitted per person during the Promotional Period. Entry is limited to one (1) entry per entrant per each entry period.
d. The competition is advertised on the Cowboys social media channels and at the Cowboys home game on Saturday 29 August.
e. The competition is advertised on BMD Group approved websites, social media channels and email communications. [23.1]
f. During the competition period, participants will be able to participate in the quiz, where they will be required to answer questions relating to different job roles available at BMD Group and provide their contact details to be eligible to be in the running for the Prize. The quiz is provided as an engagement tool only and is not a recruitment assessment, employment screening process or job application. Participation in, or performance on, the quiz will not affect a participant's chances in the random prize draw and does not guarantee employment, an interview, or preferential consideration for any role with BMD Group.
21. Entries are restricted to one (1) per person. Incomplete or indecipherable entries will be deemed invalid.
Entry eligibility requirements:
23. Entrants must be Australian residents and must be aged 18 years or over at the time of entry.
24. Employees of BMD Group and its related entities, and their immediate family members, are not eligible to enter this competition.
25. Employees, officers and immediate family members of the Cowboys, Greenroom, Tradeable Bits, involved agencies and price suppliers, are not eligible to enter this competition.
26. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
Selection of winners:
27. The Promotion is a game of chance, the winner will be selected by a random computerised draw.
28. The winner will be notified by email / phone by Monday 21 September 2026.
29. The prize will be posted to the winner within four (4) weeks of successful contact.
30. The Promoter’s decisions are final and no correspondence will be entered into.
Unclaimed prizes:
28. All reasonable attempts will be made to contact the winner. If the Prize is not claimed by the winner by the Unclaimed Prize Date, it will be awarded to another person via a random computerised second chance draw on Tuesday 29 September 2026.
29. The winners of the second chance draw, if any, will be notified in writing within two (2) business days (by Thursday 1 October 2026) of the Unclaimed Prize redraw.
30. If any winner chooses not to take their prize, or is unable to, or does not take or claim a prize by the time specified by the Promoter, or is unavailable, they forfeit the prize and the Promoter is not obliged to substitute the prize.

Terms applicable to the prize:
33. Subject to the unclaimed prize draw clause, if for any reason the winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.
34. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
35. Prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
36. Once the Prize has left the Promoter’s/Prize supplier’s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Prize.
General
39. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
40. Entrants consent to the Promoter using their name, likeness, image and/or voice if they are a winner (including in photographs, film and/or recordings) for the purpose of administering, publicising and promoting this promotion and its outcome. Such use may occur in any media and without remuneration for a reasonable period following the promotion. Any use of a winner's name, likeness, image and/or voice for broader advertising, branding, recruitment or other ongoing promotional purposes unrelated to this promotion will require the winner's prior separate consent.
41. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
42. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
43. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
44. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) participation in the prize.
45. As a condition of accepting the prize, a/the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Privacy and communication:
46. Entrants may agree to have their email address added to the Cowboys and email lists via the opt in box of the competition entry form. [41.1]
47. Entrants are able to unsubscribe from Cowboys emails at anytime by visiting the preference centre or following the unsubscribe link at the bottom of every Cowboys email.
48. We will need to collect personal information from you (such as your name and email address). In providing this information to us, you agree to the terms of the Cowboys’ privacy policy, which you can view here: https://www.cowboys.com.au/privacy-policy/
49. Each entrant must ensure that any other person whose personal details have been provided by the entrant to the Promoter for the purposes of the entrant’s participation in this Promotion has given their express consent for their details to be provided to the Promoter and any of the Related Parties and to be contacted by the Promoter or any of the Related Parties in relation to this Promotion.
